What better way to start your year off without networking with your fellow contractor's and manufacturers over lunch. Our Associate Director, JaMaya Tate is beginning off our season with a bang! New topics! New speakers! & MORE Continuing Education opportunities! Over the past few years, we have recruited more members and as always we strive to make sure we give a window of opportunity for everyone to make those connections. So let's the start this quarter off right and join the MCACO as we begin a new but old journey again!
Tom Nocar of Hahn, Loeser & Parks LLP will be hosting our first
MCACO Construction Law Series!
During this 3-part series Tom will present on construction law topics commonly encountered by the members. Considering MCACO just wrapped up negotiations we thought it would be ideal to provide education to focus on contract law, implementation best practices, litigation avoidance, and alternative dispute resolution options including mediation and arbitration.
The following topics will be discussed on the dates listed below:
Avoiding Disputes Critical Contract Terms & Best Practices in Contract Implementation
This course will provide a broad look at the top contract provisions that are commonly found at the root of a construction dispute. We’ll discuss how to limit your company’s contract risk and best practices to protect your company after the contract is signed.
Each participant will be able to identify troublesome contract terms that are frequently at the center of construction disputes. The course will also be instructive of common mistakes made in the field that can subvert an otherwise ironclad contract.

Resolving Disputes – Best Practices in Negotiation, Mediation, Arbitration, & Litigation
There are several ways to resolve a contractual dispute on a job site. Some by a simple phone call, while other require more formality and persuasion. This course is designed to take the mystery out of methods used to resolve disputes outside of the courthouse.
Each participant will learn the difference between negotiation, mediation, arbitration, and litigation as used for dispute resolution. The course will cover tried and true strategies used in each for preparing for and achieving the best results for your company.

J. Thomas “Tom” Nocar is a partner in the firm’s Litigation Practice Area in the Columbus office. Tom dedicates his practice to construction law and construction businesses. Before becoming a construction lawyer, Tom spent 26 years managing construction projects. This experience provides him with a unique set of skills to offer his clients—broad technical knowledge of the commercial construction industry and a practical approach to dispute avoidance and resolution.
Tom regularly represents construction and real estate industry clients in transactional needs (i.e., contract negotiations and drafting, teaming agreements, licensing), project claims (i.e., nonpayment, nonperformance, defect cure, delay, acceleration, mechanic’s liens), and dispute resolution including negotiation, mediation, arbitration and litigation. He is a trained arbitrator and a member of the American Arbitration Association Panel of Construction Arbitrators.
Tom is well-versed in the intricacies of commercial real estate development. He has bought, developed, leased and sold commercial property. Tom has created proformas, developed if-come design, negotiated easements and tenant leases and secured financing for projects. He has constructed infrastructure, storefronts, vanilla boxes, and lease-back developments in a variety of industries including medical, retail, industrial and office.
